Crumbtown — Terms of Service

Effective upon acceptance

Updated 10 October 2026: added Section 3(g), Ads measurement, and Section 3(h), AI creations.

1. Acceptance of Terms

Welcome to Crumbtown (the "Community"). These Terms of Service ("Terms") govern your access to and participation in the Community, including any associated communications and platforms. By clicking "Accept", checking a box indicating your agreement, submitting the online form used to join, or otherwise electronically signifying your assent when presented with these Terms, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or participate in the Community. These Terms are effective immediately upon your acceptance.

2. Description of the Community & Use of Discord

Crumbtown is an online community operating primarily through a dedicated Discord server (the "Discord Server"). Your participation in the Community inherently involves joining and using this Discord Server. Discord is a third-party platform with its own separate Terms of Service and Privacy Policy, which you also agree to abide by when using their service.

3. Privacy and Personal Information

a. Collection of Email Address: To participate in the Crumbtown community, you will be required to provide your email address via our online sign-up form. By providing your email address and accepting these Terms, you consent to Crumbtown collecting and processing this information.

b. Purpose of Use: Your email address will be used by Crumbtown for the following purposes:

  1. Administering your membership within the Community.
  2. Sending important notices regarding the Community, these Terms, or significant operational changes.
  3. Providing updates, newsletters, or other communications directly related to the Crumbtown community activities, events, and news.

c. Data Storage and Security: We take reasonable measures to protect the email addresses we collect. However, no online system is completely secure.

d. Data Retention Policy: We will retain your email address for as long as you remain an active participant in the Crumbtown community and for a reasonable period thereafter as necessary to fulfill the purposes outlined in Section 3(b), or until you request its deletion in accordance with Section 3(e). Our goal is to keep you informed about the Community for its duration unless you choose otherwise. We retain this data based on your ongoing consent provided by participating in the Community and the legitimate interest of maintaining communication with community members.

e. Data Subject Rights & Contact: You have rights regarding your personal information held by Crumbtown, including the right to access, correct, or request the deletion of your email address from our active communication records. To exercise these rights, please submit your request through our designated online form: https://form.jotform.com/261894393174973. While the form is the preferred method for efficient processing, if you encounter issues with the form, you may contact us via email at: 1lnfuf9mw@relay.firefox.com. We will process requests in accordance with applicable laws and within reasonable timeframes.

f. Discord Data: Please refer to Section 4 regarding data processed by Discord.

g. Ads measurement (OpenAI): Only if you click “Allow” on our sign-up page do we load OpenAI’s ChatGPT Ads pixel. It sets two cookies, __oppref (the ad-click ID, 30 days) and __obref (a random browser ID, 365 days), and tells OpenAI the page you visited, the referring page, the time, and that you finished signing up. Like any web request, it also reveals your IP address and browser type. We never send your form answers, email address or Discord details. OpenAI acts as a separate controller, may process this data in the United States, and may use it to measure, improve and deliver its advertising (see OpenAI’s Privacy Policy). If your browser sends a Global Privacy Control signal, we treat it as “Don’t allow”. Your choice is kept in a first-party cookie (bc_ads) for 12 months. You can change it at any time with the “Privacy choices” link at the bottom of the sign-up page; withdrawing deletes both OpenAI cookies.

h. AI creations (Build in public): Everything you submit to the free AI in the Build in public voice channel, and everything it makes for you (text, images, files, websites, games, 3D models, audio), is public. It is shown to everyone in that voice channel, posted in the Discord server (including the Build in public voice chat and #work-showcase), and published on breadcrumbsguild.org/ai-bridge. Your request is sent through our Slack workspace to SirCrumbington, an AI agent that runs on OpenAI’s ChatGPT, and OpenAI processes it under its own terms (see OpenAI’s Privacy Policy). Do not include passwords or personal information in a request. You can delete a creation with the “Delete my project” button in your request’s Discord thread, or request deletion through the form in Section 3(e).

i. Community inference purchases (“Fuel the community’s AI”): If you buy AI computing time for the community through our checkout form, we receive your Discord username, the name you use on PayPal (only to match your payment to you; never shown publicly), the display name and profile link you choose to give, your choice about a public thank-you, your acknowledgement of Section 6A, and, from PayPal, the payment details PayPal shares with sellers (your name, email address, amount, currency and transaction ID). The form is hosted by Jotform; after it, you pay on PayPal’s own page, under PayPal’s terms and privacy policy. We never see your card or bank details. We match each payment to its form entry by hand before thanking anyone. We use this information to process and record your purchase, to handle refunds and questions, to meet accounting and tax obligations, and, only if you chose “Yes, thank me publicly”, to show your chosen name, your Discord profile and your profile link on the community’s finished AI projects (in the Discord server and on breadcrumbsguild.org) until the next person’s purchase takes its place. We never show the amount you paid. If you did not choose a public thank-you, you are thanked as “an anonymous member” and nothing that identifies you is published. Our servers only receive the thank-you details you agreed to make public; your payment records stay with Jotform, PayPal and our own bookkeeping. We keep purchase records for as long as tax and accounting law requires (in Canada, generally six years) and never sell them. You can withdraw a public thank-you at any time, or ask for access, correction or deletion, through the form in Section 3(e); on request we also remove your name from posts where it was already shown.

4. Third-Party Platform: Discord

a. Reliance on Discord: The Community relies on the Discord platform for its operation. Discord is owned and operated by Discord Inc.

b. Disclaimer of Responsibility for Discord: Crumbtown expressly disclaims any responsibility or liability for the Discord platform itself. This includes, but is not limited to:

  1. The availability, functioning, or security of the Discord Server or the Discord platform.
  2. Any content posted by users, third parties, or generated by automated bots within the Discord Server.
  3. The data collection, processing, privacy practices, or security measures employed by Discord Inc.
  4. The actions or functionality of any third-party bots added to the Discord Server. Use of such bots is at your own risk.

c. Discord's Terms and Policies: Your use of the Discord Server is subject to Discord's own Terms of Service (https://discord.com/terms) and Privacy Policy (https://discord.com/privacy). You are responsible for reviewing and complying with Discord's policies.

d. Deleting Discord Data: Crumbtown does not control the data you generate or store within the Discord platform (e.g., messages, uploaded files, user activity logs maintained by Discord). To manage, access, or request the deletion of your data held by Discord, you must contact Discord Inc. directly through the procedures outlined in their Privacy Policy and platform settings. Crumbtown cannot delete this data on your behalf.

5. Compliance with Communication Laws (CASL, GDPR Principles, CAN-SPAM)

a. Consent for Commercial Electronic Messages (CEMs) under CASL: Crumbtown is committed to complying with Canada's Anti-Spam Legislation (CASL). Accepting these Terms is not consent to receive email. We ask for that consent separately, with its own optional box that starts unticked and names the sender and how to reach us. Without it, we email you only what you directly requested (for example, an infographic you asked for). Where you do opt in, messages are for the purposes stated in Section 3(b), and you can withdraw consent at any time. These messages may include content that could be considered a Commercial Electronic Message (CEM) under CASL.

b. Identification and Unsubscribe (CASL & CAN-SPAM): Every electronic message sent by Crumbtown that falls under CASL or CAN-SPAM requirements will clearly identify Crumbtown as the sender, provide necessary contact information (using the contact details in Section 11), and include a clear, functional, and readily accessible unsubscribe mechanism (e.g., an unsubscribe link or instructions) at no cost to you. Unsubscribe requests submitted via this mechanism will be processed promptly, within the legally mandated timeframe. Alternatively, you may request removal using the methods outlined in Section 5(d).

c. GDPR Principles: While governed by Canadian law, we process your data respecting core principles aligned with the GDPR. We rely on your explicit consent (given through online acceptance of these Terms) as the lawful basis for processing your email address. You retain the rights outlined in Section 3(e).

d. Withdrawal of Consent/Opt-Out: You may withdraw your consent and opt-out of receiving future non-essential electronic communications from Crumbtown at any time. The preferred method is to submit your request via our online form: https://form.jotform.com/261894393174973. Alternatively, you can use any unsubscribe mechanism provided in our communications or, if needed, contact us via email at 1lnfuf9mw@relay.firefox.com. Please note that withdrawing consent may affect your ability to receive important community updates. Essential administrative messages related to your membership status itself might still be sent if necessary.

6. User Conduct

You agree to use the Community and the Discord Server responsibly and respectfully, in compliance with these Terms, Discord's Terms, and all applicable laws. Prohibited conduct includes, but is not limited to, harassment, illegal activities, spamming, distributing malicious software, and infringing on intellectual property rights.

6A. Community Inference Purchases

a. What you are buying: Through our checkout form you can pay for AI computing time (“inference”) used for the community’s AI projects. The payment goes to Crumbtown’s organizer and is used to pay for that AI computing. It is a purchase (a tip toward the community’s AI costs), not a charitable donation, and it is not tax-deductible. It does not buy goods, access to any AI account, ownership of anything the AI makes, or any particular result, and it does not unlock features in the Discord server.

b. Public thank-you: The community’s finished AI projects thank the most recent purchaser until the next purchase. On the form you choose whether we show your name and profile; otherwise you are thanked as “an anonymous member”. We may decline to show, or remove, a name or link that breaks Section 6.

c. Refunds: Purchases are final and non-refundable, except where the law requires otherwise. If a payment is reversed or refunded, its public thank-you is removed.

d. Payments: Payments are made on PayPal’s page and the form is hosted by Jotform; their terms also apply to your payment. Amounts are chosen on the PayPal page and are in Canadian dollars. You must be at least 18, or have a parent’s or guardian’s permission, to make a purchase.

7. Disclaimers and Limitation of Liability

a. "As Is": The Community and its associated platforms (including the use of Discord) are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

b. No Liability: To the fullest extent permitted by applicable law, Crumbtown, its organizers, administrators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Community or Discord Server; (ii) any conduct or content of any third party (including other users or bots) on the Discord Server; (iii) any content obtained from the Community; or (iv) unauthorized access, use, or alteration of your transmissions or content, even if Crumbtown has been advised of the possibility of such damages.

8. Termination

Crumbtown reserves the right to suspend or terminate your access to the Community and the associated Discord Server at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms or Discord's Terms. Upon termination, your right to participate in the Community will cease immediately. Provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. We will handle your email address post-termination according to our Data Retention Policy (Section 3(d)) and applicable law, unless you request deletion earlier via the methods provided.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. You irrevocably agree that the courts located in the City of Saskatoon, Saskatchewan, Canada shall have exclusive jurisdiction to resolve any dispute or claim arising out of or in connection with these Terms or your participation in the Community.

10. Amendments to Terms

Crumbtown reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice prior to any new terms taking effect, which may include posting a notice within the Discord Server or sending an email to the address associated with your membership. What constitutes a material change will be determined at our sole discretion. By continuing to access or participate in the Community after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, you should immediately stop participating in the Community and cease using its associated platforms. If you wish to have your contact information removed from our records due to disagreement with the terms, please submit a removal request using our designated online form: https://form.jotform.com/261894393174973.

11. Contact Information

For general questions about these Terms of Service, or for inquiries/requests related to your personal information (including access, correction, deletion, or opting-out) as outlined in these Terms, the preferred method is to use our designated online form: https://form.jotform.com/261894393174973.

For other inquiries where the form may not be suitable, or if you encounter issues with the form, you may contact Crumbtown via email at: 1lnfuf9mw@relay.firefox.com

12. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and Crumbtown regarding your participation in the Community and supersede and replace any prior agreements, oral or written, regarding the Community.

AI reception

Reception is an optional AI conversation. Activating it starts a recorded conversation; recordings and transcripts are used for your request and authorized staff follow-up. Tough Tongue AI and Google Gemini process your speech. You can stop at any time. For access, correction or deletion requests, use our contact form.
